Terms of Service

By accessing or using any website, service, product, or platform operated by Kinship Quest, LLC ("KinshipQuest™," "we," "us," or "our") — including kinshipquest.com, kinshipquest.net, and kinshipquest.org — you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations.

If you do not agree to these Terms, you may not use our services. These Terms constitute a legally binding agreement between you and Kinship Quest, LLC.

KinshipQuest™ operates three distinct but related platforms, each governed by these Terms:

To use KinshipQuest™ services, you must:

• Be at least 18 years of age, or have verifiable parental or guardian consent
• Have the legal capacity to enter into binding agreements in your jurisdiction
• Not be prohibited from using our services under applicable laws
• Provide accurate, current, and complete information when required

We reserve the right to refuse service, terminate accounts, or cancel research agreements at our discretion if eligibility requirements are not met.

Certain features of kinshipquest.com and kinshipquest.net require account registration. When creating an account you agree to:

• Provide accurate and complete registration information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activity occurring under your account
• Notify us immediately at info@kinshipquest.com of any unauthorized access

A single set of credentials may be used across kinshipquest.com and kinshipquest.net where Single Sign-On (SSO) is enabled. You may not share, sell, or transfer account access to another person.

Research Services (kinshipquest.com): All research engagements are governed by a separate written research agreement. Fees are fixed-price per project as agreed in writing. A deposit may be required before research commences. Fees are non-refundable once research has begun, except as expressly stated in the research agreement.

Academy Subscriptions (kinshipquest.net): Subscriptions are billed monthly or annually in advance. You may cancel at any time; cancellation takes effect at the end of the current billing period. No prorated refunds are issued for partial periods. Annual subscriptions cancelled within 7 days of renewal are eligible for a full refund.

Donations (kinshipquest.org): All donations to KinshipQuest Legacy are voluntary and non-refundable. Kinship Quest, LLC is not a registered 501(c)(3) nonprofit; donations are not tax-deductible unless expressly stated otherwise.

• All prices are in United States Dollars (USD)
• We use Stripe for secure payment processing; card data is never stored on our servers
• Disputed charges must be raised within 30 days of the billing date
• We reserve the right to modify pricing with 30 days' written notice to active subscribers

All content on KinshipQuest™ platforms — including but not limited to course materials, written research reports, podcast recordings, blog posts, devotional writings, logos, graphics, and software — is the exclusive property of Kinship Quest, LLC or its licensed contributors, and is protected by applicable copyright, trademark, and intellectual property laws.

Research Reports: Upon full payment, clients receive a non-exclusive, personal license to use their delivered research report. Reports may not be resold, redistributed, or published without written consent.

Academy Content: Course materials are licensed for personal, non-commercial use by the subscribing account only. Downloading, sharing, or reproducing course content outside the platform is prohibited.

The KinshipQuest™ name, logo, and trademark are registered marks of Kinship Quest, LLC. Unauthorized use is prohibited.

You agree not to use any KinshipQuest™ service to:

• Violate any applicable local, state, national, or international law or regulation
• Harass, threaten, stalk, or harm any person
• Provide false, misleading, or fraudulent information
• Attempt to gain unauthorized access to our systems, other user accounts, or data
• Reproduce, distribute, or commercialize platform content without authorization
• Use automated scripts, bots, or scrapers on any KinshipQuest™ platform
• Interfere with or disrupt the integrity or performance of any service
• Use research services for purposes of harassment, stalking, or unlawful surveillance

Your privacy is important to us. Our Privacy Policy, incorporated herein by reference, describes how we collect, use, and protect your personal information across all three KinshipQuest™ domains.

By using our services, you acknowledge that genealogical research inherently involves personal and sensitive historical information about you and potentially deceased or living third parties. We handle all such information with professional discretion.

• We do not sell, rent, or share your personal data with third parties for marketing purposes
• Research documents you submit are stored securely and used only for service delivery
• Academy account data is used only to manage your subscription and deliver content
• Legacy application data is handled confidentially and shared only with assigned researchers

KinshipQuest™ services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Research Accuracy: While we apply professional genealogical standards to all research, genealogical conclusions are by nature probabilistic and dependent on available records. We do not guarantee that all ancestors will be identified, that records exist, or that findings will meet any particular legal standard beyond what is expressly agreed in writing.

Educational Content: Academy courses are educational in nature and do not constitute professional legal, medical, or financial advice.

Platform Availability: We do not guarantee uninterrupted or error-free access to any platform.

To the fullest extent permitted by applicable law, Kinship Quest, LLC, its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, loss of data, or emotional distress — arising from your use of or inability to use any KinshipQuest™ service.

In no event shall our total aggregate liability to you for all claims arising from or relating to these Terms or our services exceed the greater of: (a) the total fees paid by you to KinshipQuest™ in the twelve months preceding the claim, or (b) one hundred dollars ($100 USD).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability; in such jurisdictions our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Kinship Quest, LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of any KinshipQuest™ service
• Your violation of these Terms
• Your violation of any applicable law or third-party rights
• Any content or information you submit to us

Subscription Tiers: Explorer (free), Scholar ($19/month), and Master ($49/month) tiers each carry specific access rights as described on the platform. Tier benefits may be updated with 30 days' notice.

Course Access: Upon cancellation or downgrade, access to paid-tier content ceases at the end of the billing period. Downloaded materials must be deleted upon account termination.

Community Standards: The Academy community forum requires respectful, professional conduct. We reserve the right to remove content or suspend users who engage in harassment, spam, or conduct unbecoming of a professional research community.

Certificates: Certificates of completion are issued upon satisfying course requirements as defined within each course. Certificates represent course completion only and do not constitute professional accreditation or certification by any recognized genealogical body.

Podcast Content: Podcast episodes are produced for educational and informational purposes. Opinions expressed are those of the host and guests and do not constitute professional advice.

Social Syndication: Content published on kinshipquest.net may be automatically distributed to third-party social media platforms (Facebook, X/Twitter, Pinterest, LinkedIn, Instagram, YouTube). By submitting content to community areas, you grant us a license to syndicate that content.

Pro-Bono Research: Pro-bono research is offered at the sole discretion of Kinship Quest, LLC and is subject to application review, availability of volunteer researchers, and scope limitations. Acceptance of an application does not guarantee any specific research outcome. Pro-bono engagements carry the same professional standards as paid services but may have longer timelines.

Application Honesty: Applicants must provide truthful information regarding their financial circumstances and research goals. Fraudulent applications will result in immediate disqualification and may be reported to appropriate authorities.

Volunteer Researchers: Volunteers operate as independent contributors and are not employees of Kinship Quest, LLC. We are not liable for the actions of volunteer researchers beyond the scope of assigned cases.

Devotional Content: Devotional content on kinshipquest.org reflects the personal beliefs and perspectives of the author. It is provided for spiritual enrichment and does not constitute theological instruction, counseling, or professional advice of any kind.

Donations: Kinship Quest, LLC accepts voluntary donations to support Legacy operations. As noted in Section 5, donations are not tax-deductible unless expressly stated. Donations do not influence pro-bono application decisions.

We reserve the right to suspend or terminate your access to any or all KinshipQuest™ services at any time, with or without notice, for conduct that we determine in our sole discretion violates these Terms, is harmful to other users, or is otherwise objectionable.

You may terminate your account at any time by contacting us at info@kinshipquest.com. Upon termination, your right to use the service ceases immediately. Sections 6, 9, 10, 11, and 15 survive termination.

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, United States of America, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of KinshipQuest™ services shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Oklahoma County, Oklahoma, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last revised" date at the top of this page and, where appropriate, notify active account holders by email at least 14 days before changes take effect.

Your continued use of any KinshipQuest™ service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the service and, if applicable, cancel your subscription.
